2. Capacity as Principal

We act as principal in all transactions and do not act as agent for any third party. All works offered for sale are our property at the time of sale and are sold in our own name.

3. Business Model

We operate as an online-only fine art and antiques dealer specialising in British and European paintings, sculpture and decorative works.

Sales are conducted remotely through our website, direct enquiries and selected third-party marketplaces. Where a sale takes place through another marketplace, the applicable contractual arrangements and marketplace terms will also be relevant.

4. Products & Description

All items are antique, vintage or contemporary works.

Descriptions, attributions and condition statements are prepared in good faith using scholarship, professional experience and information reasonably available at the time of cataloguing.

Photographs are provided to assist prospective purchasers in assessing individual works. Colour, appearance and perceived scale may vary between devices and viewing conditions.

Buyers are encouraged to review the complete catalogue description and request any additional information reasonably required before purchase.

Nothing in this clause excludes or restricts liability for goods not conforming to their description or any other statutory consumer rights.

4A. Disclaimer & Catalogue Information

Our artwork descriptions, artist attributions, provenance statements, condition observations, historical research and related catalogue information should be read together with our Disclaimer & Catalogue Information.

This supplementary document explains the terminology, research methods, qualifications and limitations applicable to information published in connection with works offered for sale by Cheshire Antiques Consultant LTDĀ®.

Prospective purchasers are encouraged to review this information and contact us with any questions or requests for clarification before completing a purchase.

The Disclaimer & Catalogue Information page supplements these Terms of Service but does not replace them.

In the event of any inconsistency, the contractual terms applicable to the particular transaction shall prevail, subject always to applicable law.

Nothing in this section or the referenced disclaimer excludes, restricts or otherwise affects statutory consumer rights or remedies that cannot lawfully be excluded or restricted.

4B. ArtPlacer Virtual Artwork Visualisation

Cheshire Antiques Consultant LTDĀ® provides access to ArtPlacer, a third-party digital artwork visualisation service, on selected fine art listings.

ArtPlacer enables prospective purchasers, collectors and interior designers to preview how eligible paintings may appear in digitally generated interior settings or, where supported, photographs of their own rooms.

Purpose of the Service

ArtPlacer is an optional visualisation aid intended to assist with artwork selection, interior planning and the consideration of possible display arrangements.

The service does not constitute a physical examination, independent condition assessment, authentication or guarantee of how an artwork will appear in a particular interior.

Colour, Scale and Appearance

Digital visualisations may differ from the physical artwork in colour, tone, texture, surface characteristics, framing details, lighting, proportions and apparent scale.

Such differences may arise from photographic perspective, room measurements, screen calibration, lighting conditions, image processing and the technical characteristics of the software.

Prospective purchasers should refer to the published dimensions, catalogue description, photographs and condition information provided within the individual artwork listing when assessing its physical characteristics.

Additional photographs, measurements, condition information and private remote video viewings may be requested before purchase.

Availability and Scope

ArtPlacer is available on eligible fine art listings only and does not currently extend to our sculpture or decorative arts collections.

Availability and functionality may vary according to the individual artwork, device, browser and third-party service arrangements.

We may modify or discontinue access to this optional feature, subject to any applicable contractual obligations and statutory rights.

Third-Party Technology and Privacy

ArtPlacer is provided using third-party technology.

Where users choose to upload photographs or other information, the processing of that information may be subject to the applicable privacy notices and terms of the service provider.

Users should review the relevant privacy information before uploading photographs containing personal information or identifiable details of private premises.

Further information concerning personal data is available in our Privacy Policy.

Important Information and Consumer Rights

ArtPlacer visualisations are illustrative and should not be treated as a guarantee of exact colour reproduction, physical scale, appearance or suitability for a particular interior.

Further details are available in Section 12A of our Disclaimer & Catalogue Information.

Nothing in this section excludes or restricts any statutory consumer rights or remedies, including rights concerning goods being as described.

5. Attribution

Attributions are matters of professional opinion honestly and reasonably held, based upon the information and evidence available at the time of cataloguing.

Where a particular attribution forms part of the contractual description of an artwork, nothing in these Terms excludes or restricts the purchaser's applicable statutory rights if the work does not conform to that description.

6. Age & Condition

Works may show signs of age, restoration, craquelure, wear, patination or historical alteration consistent with their nature and age.

Such characteristics are assessed in the context of the individual work and, where material and known to us, are disclosed in the relevant catalogue description or condition information.

Normal age-related characteristics do not automatically constitute defects, but this provision does not exclude statutory rights relating to satisfactory quality, description or fitness for purpose.

7. Buy with Confidence

In addition to applicable statutory rights, we offer the following voluntary assurance.

Where, within 30 days of delivery, a purchaser provides written evidence from a recognised independent expert or authority in the relevant field, acceptable to us acting reasonably, demonstrating that a work has been materially misdescribed or incorrectly attributed, we will refund the purchase price upon the safe return of the work in the condition supplied.

This voluntary assurance is separate from and additional to statutory consumer rights.

The 30-day period and evidential requirements stated above do not restrict any longer or additional remedies available under applicable law.

7A. Rescission

If a credible third-party ownership or restitution claim arises concerning a work, we may seek to rescind the sale where legally permissible.

Any rescission, return of the work and refund will be handled in accordance with the applicable contractual arrangements, relevant law and the rights of the parties.

Nothing in this section permits unilateral removal of statutory rights or remedies.

8. Returns & Cancellations

Consumers entering into qualifying distance contracts generally have a statutory right to cancel within 14 days after receiving the goods, subject to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and any applicable exceptions.

Where the statutory cancellation right applies, the consumer may notify us of cancellation using a clear statement within the applicable cancellation period.

Following cancellation, the consumer must return the goods within the period required by applicable law unless we have agreed to collect them.

Consumers are encouraged to return artworks using secure protective packaging, appropriate tracking and suitable transit insurance, taking account of the value and fragile nature of the work.

Where we have informed the consumer of the applicable return costs before the contract was concluded, the consumer may be responsible for the direct cost of returning goods following a change-of-mind cancellation, as permitted by law.

Where goods are faulty, materially not as described or otherwise fail to conform to the contract, return costs and remedies will be determined in accordance with applicable consumer protection legislation.

Consumers may be responsible for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, where permitted by law.

Following a valid statutory cancellation, refunds will include the payments required by law, including applicable standard outbound delivery charges. Additional delivery charges arising from a consumer's choice of a more expensive delivery method need not be refunded where the law permits.

Refunds will be made within the applicable statutory timescales, using the original payment method unless the consumer expressly agrees otherwise and incurs no fee as a result.

We will provide appropriate return instructions, including the return address and any information reasonably required for safe transportation or international customs procedures.

Failure to follow a preferred courier or administrative instruction does not, by itself, invalidate a statutory cancellation right.

Further information is available in our Refund Policy.

8A. Negotiated, Discounted & Multi-Work Transactions

Where a discretionary discount or individually negotiated price has been agreed in writing, that price forms part of the relevant sale agreement.

A negotiated or discounted price does not, by itself, remove statutory consumer cancellation rights or remedies concerning faulty or misdescribed goods.

Where multiple works are sold together at an agreed aggregate price, the contractual allocation of that price and any request for partial return will be assessed according to the nature of the transaction and applicable law.

Where statutory rights apply, they take precedence over any inconsistent contractual provision.

International returns may involve export, re-import and customs formalities. Responsibility for associated costs will depend upon the applicable delivery terms, reason for return and relevant law.

9. Payment Methods

Debit and credit cards, Apple Pay, Google Pay, PayPal and Klarna are accepted, where available, for transactions up to GBP 5,000.

Transactions exceeding GBP 5,000 must be settled by cleared bank transfer unless otherwise agreed in writing.

Alternative payment methods, including cash on collection up to GBP 8,000, may be accepted strictly by prior written agreement and subject to applicable legal and anti-money laundering requirements.

Collection is strictly for fulfilment purposes and does not constitute the provision of public viewing or inspection facilities.

All payments must be made in GBP unless otherwise agreed in writing.

Where refunds are required, we will refund the amount due under the contract and applicable law.

For statutory consumer refunds, we will not deduct our own payment processing charges or impose refund fees contrary to applicable legislation.

Currency conversion differences and charges imposed independently by a purchaser's bank or payment provider may arise where payments involve foreign currencies. Such charges are outside our direct control, but this does not reduce any refund obligation imposed upon us by law.

Nothing in this section excludes or restricts statutory consumer rights concerning payments or refunds.

10. Shipping & Delivery

We arrange UK and worldwide shipping using established professional carriers and specialist fine art transport providers where appropriate.

Delivery times are estimates unless a particular delivery date has been expressly agreed as binding.

Our obligations concerning delivery times, delays and remedies remain subject to applicable consumer protection legislation.

International shipments are generally supplied on a Delivered at Place (DAP) basis, formerly commonly described as Delivered Duties Unpaid (DDU), unless otherwise agreed in writing.

Under DAP arrangements, the buyer is generally responsible for applicable import duties, import taxes, customs clearance charges and destination-country import requirements.

Responsibility for export licences, cultural property restrictions and related documentation will be determined according to applicable law and the agreed contractual arrangements.

Some artworks may require export licences or other permissions before dispatch. Where such requirements apply, shipment may be delayed until the necessary documentation has been obtained.

Shipping, insurance and packaging arrangements are further described in our Shipping Policy.

11. Risk & Title

For consumer sales, risk in the goods generally passes to the purchaser when the goods come into the physical possession of the purchaser or a person identified by the purchaser to take possession, subject to applicable law.

Where a consumer independently commissions a carrier not offered by us, different statutory provisions concerning the passing of risk may apply.

Title to the goods shall not pass to the buyer until full payment has been received by us in cleared funds, subject to applicable law.

We warrant that we have the right to sell all works offered for sale and that, to the best of our knowledge, title to the works is free from undisclosed encumbrances.

12. VAT Margin Scheme

Cheshire Antiques Consultant LTDĀ® is VAT registered in the United Kingdom under VAT number GB 466128775.

Where applicable, sales are conducted under the UK VAT Margin Scheme for second-hand goods, works of art, antiques and collectors' items.

Under the Margin Scheme, VAT is accounted for on the seller's margin and is not separately itemised on invoices.

Accordingly:

  • VAT may not be recoverable by the buyer.
  • No separate VAT breakdown will be provided for Margin Scheme sales.
  • VAT treatment may vary depending on the nature and source of the work sold.

Where a transaction is not conducted under the Margin Scheme, the applicable VAT treatment will be stated separately in writing.

13. Anti-Money Laundering Compliance

Cheshire Antiques Consultant LTDĀ® is registered with HM Revenue & Customs as an Art Market Participant under registration number XRML00000211615.

We are subject to the applicable requirements of the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017, as amended.

We undertake customer due diligence and other compliance measures where required, including in relation to transactions meeting applicable thresholds, linked transactions and circumstances requiring enhanced scrutiny.

This may involve obtaining and verifying identification, address information, beneficial ownership information where relevant, and information concerning the source of funds.

We may request information and documentation at any stage of a transaction where necessary to comply with our legal and regulatory obligations.

We reserve the right to delay, decline or terminate a transaction where necessary to meet applicable anti-money laundering, sanctions or other legal requirements.

We comply with applicable reporting obligations to relevant UK authorities, including the National Crime Agency where appropriate, and with legal restrictions concerning the disclosure of such reports.

14. No Valuations, Investment Advice or Reliance

We do not provide independent valuations, appraisals, authentication services or investment advice.

Any statements regarding value, pricing, market conditions, provenance or potential future performance are provided in connection with works offered for sale and reflect our professional dealer assessment where applicable.

We do not guarantee future market value, investment performance or resale value.

Artwork should not be purchased in reliance upon an expectation of future financial return.

All offers submitted by prospective buyers are considered at our discretion. We are under no obligation to accept or negotiate an offer.

Informal discussion, correspondence or the exchange of catalogue information does not, by itself, establish a separate valuation, appraisal or advisory relationship.

Nothing in this section excludes liability for misleading statements, misrepresentation or other liability that cannot lawfully be excluded.

15. Limitation of Liability

Nothing in these Terms excludes or restricts liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights and remedies that cannot lawfully be excluded or restricted.

Subject to those protections and applicable law, we shall not be liable for losses that were not reasonably foreseeable when the contract was made or that arise from circumstances for which we are not legally responsible.

For business purchasers, any applicable limitation of liability shall operate only to the extent permitted by law and subject to applicable statutory controls.

16. Force Majeure

We shall not be responsible for delays or failures caused by events beyond our reasonable control to the extent permitted by law.

Where such circumstances affect the performance of a consumer contract, the purchaser's applicable rights concerning delivery, cancellation, refunds and other remedies remain unaffected.

17. Intellectual Property

Cheshire Antiques Consultant LTDĀ® is a registered trade mark in the United Kingdom under registration number UK00004303420.

Original catalogue descriptions, attribution analysis, research commentary, photography and other content created by Cheshire Antiques Consultant LTDĀ® are protected by applicable copyright, database rights and intellectual property legislation.

ArtPlacer and its associated technology are third-party services and are not represented as proprietary technology belonging to Cheshire Antiques Consultant LTDĀ®.

18. Third-Party Marketplace Sales

Where purchases are made through third-party marketplaces, the applicable marketplace terms, contractual arrangements and policies may also apply.

Where a marketplace acts as the contractual seller, the identity of the seller and the applicable sale terms will be determined by the relevant transaction arrangements.

Nothing in this section excludes statutory consumer rights or overrides mandatory legal requirements.

19. Prop Hire & Loan Services

Selected works may be available for film, television, photography, interior design or other production purposes by prior agreement.

All prop hire or loan arrangements are governed by separate written agreements.

Availability, permitted use, duration, transport, insurance, condition and liability for hired or loaned works will be determined by those agreements and applicable law.

20. Privacy

We process personal data in accordance with applicable UK data protection legislation.

Further details, including our Information Commissioner's Office registration number ZB687093, are provided in our Privacy Policy.

Where third-party services such as ArtPlacer are made available through our website, relevant privacy notices and information concerning any applicable data processing arrangements should also be consulted.

21. Governing Law

These Terms are governed by the laws of England and Wales.

Where a purchaser is a consumer resident outside England and Wales, this provision does not deprive that consumer of any mandatory protections available under applicable law.

Nothing in these Terms restricts any statutory right to bring proceedings in a court having jurisdiction under applicable law.
