1. About Us

These Terms of Service govern the use of this website and the sale of goods by Cheshire Antiques Consultant LTD® (“we”, “us”, “our”), a private limited company registered in England and Wales.

2. Capacity as Principal

We act as principal in all transactions and do not act as agent for any third party. All works offered for sale are our property at the time of sale and are sold in our own name.


3. Business Model

We operate as an online-only art dealer specialising in fine art, sculpture, and decorative works. All sales are conducted remotely.


4. Products & Description

All items are antique, vintage, or contemporary works.

Descriptions, attributions, and condition statements are expressions of opinion based on scholarship, expertise, and market knowledge reasonably held at the time of listing.

Photographs are provided for guidance only.

Buyers are responsible for satisfying themselves as to the description, condition, and suitability of any work prior to purchase.

Nothing in this clause excludes liability for goods materially not as described under applicable law.


5. Attribution

Attributions are matters of opinion honestly and reasonably held and are not guaranteed unless expressly confirmed in writing.


6. Age & Condition

Works may show signs of age, restoration, craquelure, wear, patination, or historical alteration consistent with their nature and age. Such characteristics shall not constitute defects.


7. Authenticity Guarantee

If within 30 days of delivery you provide written evidence from a recognised independent expert or authority in the relevant field, reasonably acceptable to us (such acceptance not to be unreasonably withheld), that a work is not authentic, we will refund the purchase price upon safe return of the work in the condition supplied.

This guarantee is separate from and in addition to statutory consumer rights.

7A. Rescission

If a credible third-party ownership or restitution claim arises, we reserve the right to rescind the sale. Upon return of the work, the purchase price paid shall be refunded.


8. Returns & Cancellations

Consumers have a statutory right to cancel within 14 days of delivery in accordance with the Consumer Contracts Regulations 2013.

Returned works must be in the same condition as delivered, as verified against condition documentation and photographs taken prior to dispatch.

Buyers are responsible for secure packaging and insurance during return unless the work is materially not as described.

Risk in returned goods remains with the buyer until safe receipt by us, and we accept no liability for loss or damage in transit.

Returned goods must not be sent without prior written authorisation and instructions from us.

8A. Negotiated, Discounted & Multi-Work Transactions

Where a discretionary or substantial discount has been agreed in writing prior to purchase, the transaction shall be deemed a negotiated sale reflecting agreed commercial consideration.

Except where statutory rights apply or where a work is materially not as described, such sales are final.

Where multiple works are sold as a group at an agreed aggregate price, we may treat the transaction as a single contract for pricing purposes. Requests for partial return or cancellation will be considered on a case-by-case basis.

  • The buyer remains responsible for secure packaging and full transit insurance. The buyer is responsible for export, re-import and customs formalities. Import duties, customs charges and related costs are non-refundable.

9. Payment Methods

Debit and credit cards, Apple Pay, Google Pay, PayPal and Klarna are accepted for transactions up to £5,000 GBP.

Transactions exceeding £5,000 GBP must be settled by cleared bank transfer unless otherwise agreed in writing. Alternative payment methods (including cash on collection) may be accepted strictly by prior written agreement and subject to applicable legal limits. Collection is strictly for fulfilment purposes only and does not constitute viewing or inspection facilities.

All payments must be made in GBP unless otherwise agreed in writing.

Refunds are issued in GBP only and are limited to the amount of cleared funds received by us.

We are not responsible for:

  • exchange rate fluctuations;
  • bank charges, including intermediary or correspondent bank fees;
  • payment processor fees (including but not limited to PayPal or Klarna); or
  • any differences between the amount sent by the buyer and the amount received by us.

Any such costs incurred on payment or refund are the responsibility of the buyer.


10. Shipping & Delivery

We arrange worldwide shipping using professional carriers.

Delivery times are estimates only and are not guaranteed.

International shipments are generally supplied on a Delivered At Place (DAP) basis (formerly referred to as Delivered Duties Unpaid (DDU)) unless otherwise agreed in writing. The buyer acts as importer of record and is responsible for compliance with all applicable customs and import requirements.

The buyer is responsible for all import duties, taxes, and customs charges.

Export licences or cultural property restrictions may apply to certain works. Responsibility for obtaining any required licences rests with the buyer unless otherwise agreed in writing.


11. Risk & Title

Risk in the goods passes to the buyer upon delivery or, where applicable, upon collection.

Title to the goods shall not pass to the buyer until full payment has been received by us in cleared funds.

We warrant that we have the right to sell all works offered for sale and that, to the best of our knowledge, title to the works is free from undisclosed encumbrances.


12. VAT Margin Scheme

Cheshire Antiques Consultant LTD is VAT registered in the United Kingdom (VAT No. GB 466128775).

Where applicable, sales are conducted under the UK VAT Margin Scheme for second-hand goods, works of art, antiques and collectors’ items.

Under the Margin Scheme, VAT is accounted for on the seller’s margin and is not separately itemised on invoices.

Accordingly:

  • VAT may not be recoverable by the buyer;
  • no separate VAT breakdown will be provided for Margin Scheme sales; and
  • VAT treatment may vary depending on the nature and source of the work sold.

Where a transaction is not conducted under the Margin Scheme, the applicable VAT treatment will be stated separately in writing.


13. Anti-Money Laundering Compliance

Cheshire Antiques Consultant Ltd is subject to the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 (as amended) and is supervised by HM Revenue & Customs under registration number XRML00000211615.

In accordance with these regulations, we are required to carry out customer due diligence and ongoing monitoring in relation to certain transactions, including those meeting applicable thresholds or where otherwise required on a risk-sensitive basis. This may include obtaining and verifying proof of identity, address, and information relating to the source of funds.

We may request such information at any stage of a transaction, and the completion of a transaction is conditional upon the provision of information and documentation satisfactory to us for compliance purposes. We reserve the right to delay, refuse, or terminate a transaction where necessary to meet our legal and regulatory obligations.

We are required to comply with applicable reporting obligations to relevant UK authorities, such as the National Crime Agency, where appropriate. We are not permitted to disclose to clients or third parties where a report has been made.


14. No Valuations, Investment Advice Or Reliance

We do not provide formal valuations, appraisals, or investment advice unless expressly agreed in writing.

Any statements regarding value, pricing, market conditions, provenance, or potential future performance are expressions of opinion only and are provided for general informational purposes.

No reliance should be placed on any such statements when making purchasing or investment decisions. We do not accept responsibility for any financial loss, market fluctuation, or change in value of any work.

All offers submitted by prospective buyers are considered at our sole discretion. We are under no obligation to accept, respond to, or negotiate any offer.

Any informal discussion, correspondence, or exchange of information does not constitute a valuation service, advisory relationship, or contractual obligation on our part.


15. Limitation of Liability

Nothing in these Terms excludes liability where unlawful.

To the fullest extent permitted by law, our total liability shall not exceed the purchase price paid.

We shall not be liable for indirect or consequential loss.


16. Force Majeure

We shall not be liable for delays or failures caused by events beyond our control.


17. Intellectual Property

Cheshire Antiques Consultant LTD® is a registered trade mark in the United Kingdom (UK00004303420).

All images, descriptions, and website content are the intellectual property of Cheshire Antiques Consultant LTD® and are protected by copyright, database rights, and applicable intellectual property laws.

Unauthorised use, reproduction or distribution is strictly prohibited.


18. Third-Party Marketplace Sales

Where purchases are made via third-party platforms, the platform’s terms and policies shall take precedence where applicable.


19. Prop Hire & Loan Services

All prop hire or loan arrangements are governed by separate written agreements. Availability, condition and liability for hired works are defined exclusively in such agreements.


20. Privacy

We process personal data in accordance with UK data protection law. Further details, including our ICO registration (ZB687093), are set out in our Privacy Policy.


21. Governing Law

These Terms are governed by the laws of England and Wales.
