Cheshire Antiques Consultant LTD® provides catalogue descriptions, attribution information, provenance details, condition observations and historical research in good faith, based upon the information and evidence reasonably available to us at the time of cataloguing.
This page explains the basis upon which such information is prepared and presented and should be read together with our Terms of Service, Refund Policy, Shipping Policy and other applicable policies.
Nothing contained on this page is intended to exclude, restrict or otherwise affect any statutory rights or remedies that cannot lawfully be excluded or restricted.
1. Dealer Capacity
Cheshire Antiques Consultant LTD® is an independent fine art dealer acting as principal in the sale of works held as our own stock, unless expressly stated otherwise.
We do not provide independent valuation, appraisal, authentication, investment, financial, legal, tax, brokerage, consignment, sourcing or other professional advisory services.
Catalogue information is provided in connection with works offered for sale by Cheshire Antiques Consultant LTD® and should not be treated as independent professional advice.
2. Attribution and Research
Our catalogue descriptions and research are prepared using our professional experience within the fine art market together with, where appropriate, published literature, auction records, museum and institutional collections, archival material, inscriptions, labels, provenance information, comparative examples and other available sources.
Statements concerning authorship, attribution, school, circle, studio, workshop, follower, manner, date, period, origin, sitter, subject, location, historical context or other matters of identification or interpretation may represent our professional opinion rather than a definitive statement of fact unless expressly stated otherwise.
Attributions and interpretations may subsequently be refined, expanded or revised as a result of new documentary evidence, technical examination, conservation analysis, scholarly research or changes in generally accepted academic opinion.
We reserve the right to correct, supplement, update or withdraw catalogue information where further research, documentary evidence, technical examination or other relevant information becomes available. This does not affect any rights or remedies arising in relation to a completed transaction under applicable law or the contractual terms governing that transaction.
3. Artist Attributions
Where a work is described as being by a named artist, this represents our good-faith opinion that the work is by that artist, based upon the evidence reasonably available to us at the time of cataloguing.
Terms including Attributed to, Studio of, Workshop of, Circle of, Follower of, Manner of, School of, After and similar qualifications describe different forms or degrees of artistic association and should not be interpreted as equivalent to an unqualified attribution to the named artist.
Any qualification or explanation contained within an individual artwork catalogue entry should be considered together with the complete description of that work.
4. Dates and Period Descriptions
Dates and periods expressed approximately, including terminology such as circa, c., early, mid, late, 17th century, 18th century, 19th century or similar descriptions, represent good-faith assessments based upon the evidence reasonably available to us.
Such dates should be understood as approximate unless supported by definitive documentary or other compelling evidence.
Dating may be informed by factors including materials, construction, technique, style, inscriptions, labels, provenance, framing, comparative works and historical context.
5. Signatures, Inscriptions, Labels and Marks
References to signatures, monograms, inscriptions, dates, labels, stamps, seals, inventory numbers, manufacturers' or suppliers' marks and other identifying features are based upon our examination of the work and information reasonably available to us.
Unless expressly stated otherwise, the presence of a signature, inscription, label, stamp or other mark should not by itself be interpreted as independent authentication of authorship, date, provenance or origin.
Such features are considered together with the wider available evidence when preparing a catalogue description.
Where wording is transcribed from an inscription, label, stamp or other mark, minor uncertainty may arise where text is worn, indistinct, damaged, obscured or otherwise difficult to interpret.
6. Sitter, Subject and Location Identification
The identification of a sitter, historical person, building, landscape, geographical location, vessel, military unit, event or other subject may sometimes depend upon inscriptions, labels, provenance, family tradition, historical comparison, topographical analysis or other circumstantial evidence.
Where an identification is expressed using terminology such as possibly, probably, believed to be, traditionally identified as, by repute, suggested as or similar wording, the identification should be understood as a qualified professional opinion rather than a definitive identification.
7. Provenance
Provenance is stated according to information and documentation reasonably available to us.
Unless expressly stated otherwise, a stated provenance should not be interpreted as representing a complete or uninterrupted history of ownership from the date of creation to the present day.
Where provenance or historical information has been supplied by a previous owner, auction house, dealer or other third party, we may identify it using terminology including by repute, according to the previous owner, traditionally believed, or similar wording.
References to previous collections, owners, dealers, auction houses, exhibitions or institutions are provided as provenance or research information and do not necessarily imply endorsement by those persons or organisations.
8. Condition, Age and Restoration
Historic and antique works of art naturally exhibit characteristics associated with age, handling, display, environmental conditions, previous framing and conservation or restoration.
Depending upon the individual work, these may include craquelure, surface wear, discolouration, old cleaning, retouching, relining, patching, repairs, losses, abrasions, previous restoration, stretcher or support changes and other evidence of age.
Condition information is provided in good faith and should be considered in the context of the age, medium, construction and history of the individual work.
Condition descriptions and reports represent visual dealer assessments unless expressly stated otherwise and do not constitute formal conservation reports.
Works are not necessarily examined out of their frames, linings, mounts, glazing, sealed backs or other enclosures unless expressly stated.
Where material condition issues are known to us, these will be described in the relevant catalogue entry.
Prospective purchasers are welcome to contact Cheshire Antiques Consultant LTD® before purchase should they require further condition information, photographs or clarification regarding a particular work.
Nothing in a condition description is intended to limit any statutory rights applicable to a sale.
9. Technical and Ultraviolet Examination
Where ultraviolet light examination, magnification or another non-invasive examination method is mentioned in a catalogue entry, the observations recorded relate only to what was reasonably apparent during that examination.
Such observations should not be interpreted as comprehensive scientific, technical or conservation analysis.
Unless expressly stated otherwise, works have not been subjected to laboratory analysis, pigment analysis, X-radiography, infrared imaging, dendrochronology or other specialist scientific examination.
10. Frames and Glazing
Frames accompanying artworks may themselves be historic objects and may exhibit wear, losses, repairs, restoration, movement, cracking, separation or other characteristics associated with age.
Unless expressly stated otherwise, a frame should not be assumed to be original to the artwork or contemporary with its creation.
References to a frame as original, period, antique, later, associated or using similar terminology represent our good-faith assessment based upon its construction, appearance and relationship to the artwork.
Frames are generally supplied with an artwork as presented unless otherwise stated.
Where an artwork is supplied with a frame, the condition and construction of the frame should be considered separately from the condition of the artwork itself.
Historic or existing glazing may exhibit marks, imperfections, reflections, optical variations or other characteristics consistent with its age and construction unless otherwise stated.
11. Dimensions
Dimensions are provided in good faith and are normally approximate.
Where appropriate, dimensions may distinguish between the visible image, canvas, panel, sheet or other support and the overall framed dimensions.
Minor variations may occur as a result of measurement methods, irregular historic frames, supports or other physical characteristics.
12. Photography, Images and Colour
We endeavour to represent works accurately through photography and digital imagery.
However, colour, tone, contrast, surface texture, appearance and perceived scale may vary according to photographic lighting, image processing, monitor or screen calibration and the device upon which images are viewed.
Digital images should therefore not be regarded as an exact substitute for examining the physical work.
Additional photographs and remote private video viewings may be available where appropriate.
13. Certificates of Sale & Dealer Attribution
Where stated in the relevant catalogue entry, an artwork will be supplied with a Certificate of Sale & Dealer Attribution issued by Cheshire Antiques Consultant LTD®.
The certificate records relevant catalogue information, attribution, provenance as stated and details of the sale as part of the work's continuing ownership and provenance record.
Unless expressly stated otherwise, a Certificate of Sale & Dealer Attribution is not an independent certificate of authenticity, valuation or appraisal and should not be interpreted as such.
14. Prices and Investment Advice
Our asking prices are commercial prices for works held as stock and may take account of factors including acquisition cost, authorship or attribution, quality, rarity, subject, condition, provenance, research, market information and our own commercial judgement.
An asking price is not an independent valuation or appraisal.
Cheshire Antiques Consultant LTD® does not provide investment or financial advice and makes no representation or guarantee concerning future market value, investment performance or resale value.
Art should not be purchased in reliance upon an expectation or representation of future financial return.
15. Third-Party Sources
Catalogue research may refer to museums, galleries, archives, auction houses, libraries, academic databases, artist foundations, catalogues raisonnés, scholarly publications and other third-party sources.
Such references are provided for research and contextual purposes. Unless expressly stated otherwise, they do not mean that the relevant third party has examined, authenticated, endorsed or approved the particular artwork offered by Cheshire Antiques Consultant LTD®.
Third-party information may subsequently be amended, corrected, expanded or updated by its publisher.
16. Collectors Journal and Editorial Content
Articles within our Collectors Journal and other editorial material published by Cheshire Antiques Consultant LTD® are provided for general educational, historical and informational purposes.
Historical interpretation and scholarly understanding may develop as new evidence becomes available.
Editorial content should not be treated as valuation, authentication, investment, legal, financial, tax or other professional advice.
17. Shipping, Customs and Export
Shipping, transit protection or insurance, customs, import duties, taxes and export licensing requirements are subject to the applicable terms of sale, shipping arrangements and laws or regulations relevant to the particular transaction and destination.
International purchasers are responsible for complying with applicable import requirements and for paying duties, taxes or other charges for which they are legally responsible.
Shipments are insured for their declared value unless otherwise agreed. Insurance typically covers the artwork itself, being the painted or artistic surface. Frames are not insured separately unless additional cover is agreed in writing prior to dispatch.
Frames and glazing are nevertheless professionally packaged with appropriate consideration given to their age, construction and condition.
Any specific exclusions, limitations or additional cover requirements should be confirmed with Cheshire Antiques Consultant LTD® before shipment.
18. Statutory Consumer Rights
Nothing in this Disclaimer & Catalogue Information page, our catalogue descriptions or any other website information is intended to exclude, restrict or otherwise affect statutory consumer rights or remedies that cannot lawfully be excluded or restricted.
Where applicable, consumers retain their rights concerning goods being as described, of satisfactory quality and fit for any particular purpose made known and accepted in accordance with applicable law.
Customers purchasing remotely may also have statutory cancellation rights where applicable, subject to the relevant legislation and any lawful exceptions.
